I understand that programs of this nature contain an element of hazard and, in consideration of my child or/and the child in my care being permitted to take part in the program, I agree to save harmless and keep indemnified Sail Georgian Bay, and their respective instructors, coaches, directors, agents, officials, servants and representatives from and against all claims, actions, costs, expenses and demands in respect to death, injury, loss, damage to person or property, howsoever caused, arising out of or in connection with taking part in Sail Georgian Bay's activities, notwithstanding that the same may have contributed to or caused or occasioned by the negligence of the same bodies or any of them, or their instructors, coaches, directors, agents, officials, servants or representatives. I also understand that Sail Georgian Bay is responsible for supervision of my child during class time only. If I cannot supervise my child outside these times, it is my responsibility to arrange for alternate supervision. I further understand and agree that this release is binding upon myself, my heirs, executors and assigns. By confirming registration, I am verifying that I have read through and agree to the terms and conditions outlined above. I understand it is the sole responsibility of the individual registrant attending the course(s) to ensure that they meet all of the registration requirements. Registrants who do not meet the age requirements and/or course prerequisites will not receive course completion credit.  
 2. Refunds and Cancellations: Cancellations: we can only issue a refund if given 4 weeks notice prior to the start of the course (28 days). A $60 administrative fee will be deducted. Transfer to another week is free, if spots are available. In order to request a refund, please contact Sail Georgian Bay at [email protected] with the order number and registrant name. Refunds will be made with the same method as the original payment.  Sail Georgian Bay reserves the right to refuse a refund or exchange that does not meet the outlined terms.  No refunds will be given for poor weather conditions. Every effort is made to get out on the water but safety is our primary concern.
 At Sail Georgian Bay, we are committed to providing a safe, enjoyable, and respectful learning environment for all participants. Sailors are expected to follow all safety rules, instructions from instructors, and the Code of Conduct. If a sailor repeatedly disregards these rules or engages in behavior that endangers themselves or others, we will make every reasonable effort to address the issue and find a solution. However, if the behaviour persists and no resolution is possible, Sail Georgian Bay reserves the right to dismiss the participant from the program without a refund. 3. Waiver and assumption of risks In consideration for the privilege of Minor participating in the Event, the sufficiency of which is hereby acknowledged, I, on my own behalf and/or on behalf of Minor, agree to release and to hold harmless Sail Georgian Bay (SGB), and the respective directors, volunteers, coaches / instructors (hereinafter collectively “Releasees”) from any and all liability, whether caused by negligence of the Releasees or otherwise, for any claim, judgment, loss, liability, cost and expenses (including, without limitations, attorney’s fees and costs) arising out of or connected with associated with Minor’s participation in the Event. I am aware that sailing generally and participating in Sail Georgian Bay (SGB) sailing school, lessons, programs and special events specifically and any other activities associated with the releases involve many risks, dangers and hazards including, but not limited to: changing weather conditions; changing winds, (heavy) rain, waves and other natural or manmade objects; the condition of the water and the weather; which may create blind spots or areas of reduced visibility; variable and difficult conditions; impact or collision with boats, equipment or structures used in connection with sailing, special events, lessons or programs, collision with other sailors, racers, spectators, participants, competitors, course officials; loss of balance or control; failure to act safely or within one’s own ability or to stay within designated areas; negligence of other sailors, and other persons; and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE. I am also aware that the risks, dangers and hazards referred to above exist throughout the sailing area and that many hazards are unmarked. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE OR LOSS RESULTING THEREFROM. RELEASE OF LIABILITY AND WAIVER OF CLAIMS
In consideration of the Releasees accepting my application for lessons and participation in the sailing school program and permitting my use of the boats, bathrooms, building and other area facilities (hereinafter "the facilities"), and for accepting my application to participate in sailing school, lessons and programs, special events and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows: TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES, and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, as a result of my use of or my presence on the facilities DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, RSO1990, c.02 ON THE PART OF THE RELEASEES, AND ALSO INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE; TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES, and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, as a result of my use of or my presence on the facilities DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, RSO1990, c.02 ON THE PART OF THE RELEASEES, AND ALSO INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE; TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property of or personal injury to any third party, resulting from my use of or presence on the facilities. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity; This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario and no other jurisdiction; Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of Ontario, and shall be within the exclusive jurisdiction of the Courts of the Province of Ontario. 
 4. Photo and video release I consent to photographs/video taken of minor in my care during his/her participation at Sail Georgian Bay, and to publication of the photographs/video by the Operators for advertising, promotional and marketing purposes. I release the Operator from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise which may occur or be produced in the taking of said picture or video and the publication thereof. I also waive any right that I may have to inspect and/or approve the finished product that may be used in connection therewith or the use to which it may be applied. I can send an email at any time to: [email protected] revoking my consent to photographs/videos publications. 5. Washroom Release: SGB does not have an on-site washroom. Washroom breaks to the nearby public washroom, located in the parking lot area near the sailing school, will be provided throughout the day. Children under the age of 12 years old, will be escorted to and from the washroom by an instructor or volunteer. I hereby give permission to my child and/or the child in my care to use the public washroom. 6. Concussion Code of Conduct Athlete and Parent/Guardian: In recognition of the potential seriousness of a concussion, the athlete and his /her parent or guardian commit to following the concussion protocols and expectations highlighted below. EVERY SAILOR and PARENT/GUARDIAN acknowledges they have read Ontario's Concussion Resources (available here: https://www.ontario.ca/page/rowans-law-concussion-awareness-resources ) AND that they have read and agreed to the following Ontario Sailing Concussion Code of Conduct: Concussion Code of Conduct Athlete and Participant In recognition of the potential seriousness of a concussion, I, the sailor/athlete and parents, commit to following the concussion protocols and expectations highlighted below I will help prevent concussions by: Respecting the rules of my sport Being committed to fair play and respect for all, including other athletes, coaches, and officials. I will care for my health and safety by taking concussions seriously, and I understand that: A concussion is a brain injury that can have both short and long-term effects. A blow to my head, face, neck, or body that causes the brain to move around inside the skull may cause a concussion. I don’t need to lose consciousness to have had a concussion. I have a commitment to concussion recognition and reporting, including if I think I might have a concussion I should stop participating in further training, practice or competition immediately and tell a coach; as well as reporting to my coach if I think another participant has a concussion. Continuing to participate in further training, practice or competition with a possible concussion increases my risk of more severe, longer lasting symptoms, and increases my risk of other injuries. I will not hide concussion symptoms. I will speak up for myself and others. I will not hide my symptoms. I will tell a coach, official, parent or another adult I trust if I experience any symptoms of concussion. If someone else tells me about concussion symptoms, or I see signs they might have a concussion, I will tell a coach, official, parent or another adult I trust so they can help. I understand that if I have a suspected concussion, I will be removed from sport and that I will not be able to return to training, practice or competition until I undergo a medical assessment by a medical doctor or nurse practitioner and have been medically cleared to return to training, practice or competition. I have a commitment to sharing any pertinent information regarding incidents of removal from sport with my school and any other sport organization where I am registered. I will take the time I need to recover, because it is important for my health. I understand my commitment to following the return-to-sport process. I will respect my coaches, parents, health-care professionals, and medical doctors/nurse practitioners, regarding my health and safety. I, the sailor and his/her parent or guardian, acknowledge that we have fully reviewed and commit to this Concussion Code of Conduct. 7. Sail Georgian Bay (SGB) is committed to providing an environment in which all individuals are treated with respect. In addition to prohibiting discriminatory practices, SGB works to actively promote inclusivity. Members of SGB and participants in SGB’s programs and activities are expected to conduct themselves at all times in a manner consistent with the values of SGB.
